It does, however, provide that those living in an association would have the rights and privileges conferred on us by the US Constitution and the laws of the state. I think this is the biggest step forward. It would also seem to me that this provision might take foreclosures and other abuses out of the realm of contractual law and make the argument regarding foreclosures at statutory one instead.

      Is the opposition to this solely based on the foreclosure provision?

        No the opposition to this is not based solely on the foreclosure provision.  This is a high-tech slave-master project to usurp every right a homeowner has to speak out.  It would plug up every hole the homeowner could crawl into seeking relief from the oppression many homeowners endure in these HOAs.  The developer would become the master in these communities for the lifetime of the homeowner's occupancy.  It will give developers, management companies and HOA boards more power than they should legally have.  No one in their right mind would want TUPCA to become legal in this state or any state for that matter.

It's just too bad that so many don't have access to it because if they live in a CAI controlled development, like many in our group do, they will find that the developer controlled HOA boards and their communications network (newsletters, websites, flash e-mail, etc..) will never allow this information in and through their real-estate advertising blocks they control many small local papers and even larger media to some extent. The internet is one last option and of course low tech snail mail-outs and going door-to-door. What could be more American than that (actually meeting your neighbor)...
